This week, the Danish Parliament adopted a number of amendments to the Copyright Act.
A proposal to use images as a quote was fortunately taken out of the bill before it came to a vote. BKF and several other organizations had just objected to the introduction of an option for image citation, because we believed that it would erode the artists' right to decide for themselves about the reproduction of their own works. It would also be difficult to maintain payment for the use of works in a number of contexts if images could be freely used as a quote.
A new legal provision is being introduced that it is now permitted to use works for the purpose of parody, caricature or pastiche. The use of works as parodies has so far been permitted as a fixed judicial practice. However, there have been recurring cases about this issue, most recently in 2023, when the Supreme Court approved a caricature of The Little Mermaid.
Finally, a gender-neutral word for "originator" has been introduced. The choice has fallen on "Ohaver", which is used in Norway.
